1. PLATFORM OVERVIEW

Welcome to TECHMONKS PLAY ("Platform", "Service", "We", "Us", "Our"), an online learning platform owned and operated by TECHMONKS. TECHMONKS PLAY is an OTT-style learning platform that provides recorded educational content, live interactive sessions, assignments, learning materials, and certificates of completion for educational and skill-development purposes.

Important Clarifications:

  • TECHMONKS PLAY is an educational content platform. We provide learning resources, guidance, and skill development opportunities.
  • TECHMONKS PLAY is an OTT-style learning platform providing educational and skill-development content. It does not offer professional certification, job placement, or employment guarantees.
  • This platform is NOT a job guarantee or placement service. We do not promise, guarantee, or ensure employment opportunities, job placements, or career outcomes.
  • This platform is NOT an examination body, government certification authority, or professional licensing organization. Our certificates are completion certificates, not professional certifications or government-recognized credentials.

By accessing or using TECHMONKS PLAY, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

2. USER ELIGIBILITY

2.1 Age Requirement

  • You must be at least 13 years of age to create an account and use TECHMONKS PLAY.
  • If you are between 13 and 18 years of age (a "Minor"), you represent that you have obtained parental or guardian consent to use this platform. Parents or guardians are responsible for supervising their minor's use of the platform.
  • If you are under 13 years of age, you are not permitted to use this platform.

2.2 Accurate Information

  • You must provide accurate, current, and complete information during registration and account maintenance.
  • You are responsible for keeping your account information up to date.
  • Providing false, misleading, or inaccurate information may result in account suspension or termination.

2.3 One Account Per User

  • Each user is permitted to maintain only one active account on TECHMONKS PLAY.
  • Creating multiple accounts to circumvent restrictions, access additional content, or violate these terms is strictly prohibited.

3. ACCOUNT REGISTRATION & SECURITY

3.1 Account Responsibility

  • You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, and any other authentication information.
  • You agree to notify us immediately of any unauthorized access to or use of your account.
  • You are responsible for all activities that occur under your account, whether authorized by you or not.

3.2 Platform's Limited Responsibility

  • TECHMONKS PLAY is not responsible for any loss or damage arising from unauthorized access to your account due to your failure to maintain account security.
  • We are not liable for any unauthorized transactions or activities conducted through your account.

3.3 Account Suspension

We reserve the right to suspend, restrict, or terminate your account at any time, with or without notice, if we determine that:

  • You have violated these Terms & Conditions
  • You have engaged in fraudulent, abusive, or illegal activity
  • Your account poses a security risk to the platform or other users
  • You have provided false or misleading information

4. SUBSCRIPTION PLANS & ACCESS

4.1 Available Plans

TECHMONKS PLAY offers the following subscription plans:

  • Free (Discover): Limited access to selected content for exploration purposes
  • Starter: Basic access to recorded content and learning materials
  • Pro: Enhanced access including live sessions, assignments, and priority support
  • Elite: Full platform access with all features, mentorship, and premium support

4.2 Plan Features

  • Features, content access, and benefits vary by subscription plan.
  • Detailed features for each plan are displayed on our pricing page and may be updated from time to time.
  • We reserve the right to modify, add, or remove features from any plan with reasonable notice.

4.3 Active Subscription Required

  • Access to content and features is granted only while your subscription is active and in good standing.
  • If your subscription expires, is cancelled, or payment fails, your access to premium content will be restricted according to your current plan status.
  • Free plan users have access only to content designated as free.

4.4 Non-Transferable Access

Subscription benefits, account access, and content licenses are personal to you and are non-transferable. You may not share, sell, or transfer your account or subscription benefits to any other person or entity.

4.5 Plan Changes

  • You may upgrade or downgrade your subscription plan at any time, subject to platform rules and payment processing.
  • Plan changes take effect according to our billing cycle and payment processing policies.
  • Downgrades may result in immediate loss of access to features available only in higher-tier plans.
  • Upgrades may require payment of prorated fees or immediate full payment, as determined by our billing system.

5. PAYMENTS & BILLING

5.1 Payment Processing

  • Payments are securely processed by Razorpay. TECHMONKS PLAY does not store users’ card, bank, or UPI details.
  • By making a payment, you agree to Razorpay's terms and conditions in addition to these Terms & Conditions.

5.2 Pricing

  • All prices are displayed in Indian Rupees (INR) unless otherwise stated.
  • Prices are subject to change at any time, but changes will not affect active subscriptions until renewal.
  • Applicable taxes (GST, service tax, or other government-imposed taxes) may be added to the displayed price and will be clearly indicated during checkout.

5.3 Payment Failure

  • If a payment fails, your subscription will not be activated or renewed.
  • Failed payments do not grant access to premium content or features.
  • You are responsible for ensuring that your payment method has sufficient funds and is valid.

We are not responsible for payment failures due to:

  • Insufficient funds in your account
  • Bank restrictions or limitations
  • Payment gateway technical issues
  • Network connectivity problems
  • Any other reasons beyond our direct control

5.4 Subscription Validity

  • Subscription validity begins from the date of successful payment confirmation.
  • Subscriptions are valid for the duration specified in your chosen plan (monthly, yearly, etc.).
  • Access to content is granted for the duration of your active subscription period only.

5.5 Expiry Behavior

  • Upon subscription expiry, your access will automatically revert to the Free (Discover) plan level.
  • No lifetime access is granted unless explicitly stated in writing by TECHMONKS.
  • Expired subscriptions do not provide continued access to premium content.

5.6 Auto-Renewal

  • If you have selected auto-renewal, your subscription will automatically renew at the end of each billing period.
  • You may disable auto-renewal at any time through your account settings.
  • We will attempt to charge your registered payment method for renewal. If payment fails, your subscription will expire.

6. REFUNDS & CANCELLATIONS

6.1 General Refund Policy

TECHMONKS PLAY operates on a "no automatic refunds" policy after access to content has been granted. Once you have accessed premium content or your subscription has been activated, refunds are not automatically available.

6.2 Exceptional Refunds

Refunds may be considered on a case-by-case basis at the sole discretion of TECHMONKS in exceptional circumstances, such as:

  • Technical issues preventing access that cannot be resolved
  • Duplicate payments made in error
  • Payment processing errors on our part

Any refund, if granted, will be processed within 30 business days and credited to the original payment method.

6.3 No Refunds For

  • Partial usage of subscription period
  • Change of mind or dissatisfaction with content
  • Inability to complete courses or assignments
  • Expired subscriptions
  • Account termination due to violation of terms

6.4 Free Plan Users

Users on the Free (Discover) plan are not eligible for refunds as no payment has been made.

6.5 Cancellation

Cancellation refers to stopping future renewals. Refund refers to returning paid amounts. Cancellation does not automatically result in a refund.

  • You may cancel your subscription at any time through your account settings.
  • Cancellation takes effect at the end of your current billing period.
  • You will retain access to premium content until the end of your paid subscription period.
  • Cancelled subscriptions are not eligible for refunds for the remaining period.

7. CONTENT USAGE & RESTRICTIONS

7.1 Personal Learning Only

All content on TECHMONKS PLAY, including videos, materials, assignments, and live session recordings, is provided for your personal, non-commercial educational use only. Content is licensed to you on a limited, revocable, non-exclusive, non-transferable basis.

7.2 Strictly Prohibited Activities

You are strictly prohibited from:

  • Downloading Videos: Downloading, saving, or storing any video content from the platform using any method, tool, or software
  • Screen Recording: Recording, capturing, or copying any content displayed on the platform through screen recording software, screen capture tools, or any other means
  • Sharing Login Credentials: Sharing, lending, selling, or transferring your account login credentials to any other person or entity
  • Re-selling Content: Selling, reselling, or commercializing any content, materials, or access obtained through TECHMONKS PLAY
  • Public Redistribution: Sharing, distributing, uploading, or making available any platform content on public websites, social media, file-sharing platforms, or any other public or private channels
  • Reverse Engineering: Attempting to reverse engineer, decompile, or extract content through technical means
  • Bypassing Security: Using any tools, software, or methods to bypass platform security, access controls, or content protection measures

7.3 Consequences of Violation

Violation of these content usage restrictions may result in:

  • Immediate suspension or termination of your account
  • Legal action for copyright infringement and breach of contract
  • Reporting to relevant authorities if illegal activity is involved
  • No refund of any subscription fees paid

7.4 Content Monitoring

  • We reserve the right to monitor content usage and detect violations through technical and legal means.
  • We may use digital rights management (DRM) and other content protection technologies.

8. LIVE SESSIONS & ASSIGNMENTS

8.1 Live Sessions

  • Live sessions are scheduled interactive events conducted by TECHMONKS instructors.
  • Session schedules are announced in advance, and you are responsible for attending at the scheduled time.
  • Live sessions may be subject to capacity limits, with priority given to Pro and Elite plan subscribers.

8.2 Replay Access

  • Replay access to live sessions is not guaranteed and is provided at our discretion.
  • Missing a live session does not automatically entitle you to replay access.
  • If replay access is provided, it may be limited in duration or availability.

8.3 Assignments

  • Assignments are provided for learning and skill development purposes.
  • Submission of assignments is encouraged but not mandatory unless explicitly stated.

We do not guarantee:

  • Evaluation or grading of all submitted assignments
  • Detailed feedback on every submission
  • Specific response times for assignment reviews

Evaluation and feedback, when provided, are at our discretion and may vary based on your subscription plan.

8.4 Assignment Ownership

Assignments you create and submit remain your intellectual property. By submitting assignments, you grant TECHMONKS a license to use, display, and reference your work for educational and platform improvement purposes.

9. CERTIFICATES OF COMPLETION

VERY IMPORTANT SECTION

9.1 Nature of Certificates

TECHMONKS PLAY issues Certificates of Completion ("Certificates") to users who successfully complete designated courses, seasons, or learning paths. These certificates acknowledge your completion of the educational content and your engagement with the learning materials.

9.2 Important Limitations

Certificates are NOT:

  • Professional certifications or licenses
  • Government-recognized credentials
  • Industry-standard certifications (unless explicitly stated otherwise)
  • Guarantees of job placement or employment
  • Endorsements of your skills by third-party organizations
  • Academic degrees or diplomas

9.3 No Job Guarantee

Certificates do not guarantee, promise, or ensure:

  • Job opportunities or placements
  • Career advancement
  • Salary increases
  • Professional recognition
  • Acceptance by employers or educational institutions

9.4 Certificate Verification

  • Certificates may include verification features that allow third parties to verify the authenticity of your certificate.
  • Public verification of certificates may be available in future phases of the platform (Phase-2).
  • You may share your certificate for personal or professional purposes, but you must not misrepresent its nature or value.

9.5 Certificate Revocation

We reserve the right to revoke certificates if:

  • You are found to have violated these Terms & Conditions
  • Your account is terminated for misconduct
  • The certificate was issued in error
  • You engaged in fraudulent activity to obtain the certificate

10. USER CONDUCT

10.1 Acceptable Use

You agree to use TECHMONKS PLAY in a lawful, respectful, and appropriate manner. You must not:

  • Abuse or Harassment: Engage in abusive, threatening, harassing, or discriminatory behavior toward other users, instructors, or platform staff
  • Spam: Send unsolicited messages, spam, or promotional content through platform communication channels
  • Misuse of Community Spaces: Post inappropriate, offensive, illegal, or harmful content in community forums, comments, or discussion areas
  • Harmful Activity: Engage in any activity that could harm, disrupt, or interfere with the platform, its services, or other users' experience
  • Illegal Activity: Use the platform for any illegal purpose or in violation of any applicable laws or regulations
  • Impersonation: Impersonate any person, entity, or organization, including TECHMONKS staff or instructors
  • Data Mining: Use automated tools, bots, or scripts to scrape, collect, or extract data from the platform

10.2 Platform's Rights

  • We reserve the right to monitor user activity and content posted on the platform.
  • We may remove, edit, or restrict access to any content that violates these terms or is otherwise objectionable.
  • We reserve the right to suspend or terminate accounts of users who violate these conduct guidelines.

10.3 Reporting Violations

If you encounter abusive, harmful, or inappropriate behavior, please report it to us at support@techmonksplay.com. We will investigate reports and take appropriate action at our discretion.

11. INTELLECTUAL PROPERTY

11.1 Platform Ownership

  • All content, materials, logos, trademarks, videos, text, graphics, software, and other intellectual property on TECHMONKS PLAY are owned by TECHMONKS or its licensors.
  • The platform design, user interface, and functionality are proprietary to TECHMONKS.

11.2 Content Protection

All content is protected by copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, distribution, or modification of any platform content is strictly prohibited and may result in legal action.

11.3 Limited License

By subscribing to TECHMONKS PLAY, you receive a limited, revocable, non-exclusive, non-transferable license to:

  • Access and view content for personal educational purposes
  • Use learning materials for your own skill development

This license:

  • Does not grant ownership of any content
  • May be revoked at any time for violation of these terms
  • Does not permit downloading, copying, or redistribution
  • Terminates upon cancellation or expiration of your subscription

11.4 User-Generated Content

If you submit content (comments, assignments, forum posts, etc.), you retain ownership but grant TECHMONKS a worldwide, royalty-free license to use, display, and modify such content for platform operation and improvement.

12. PLATFORM AVAILABILITY

12.1 Best-Effort Service

TECHMONKS PLAY strives to provide reliable and continuous access to our platform, but we operate on a "best-effort" basis. We do not guarantee uninterrupted, error-free, or completely secure access to the platform.

12.2 Maintenance & Outages

The platform may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues or bugs
  • Server outages
  • Network problems
  • Force majeure events (natural disasters, cyberattacks, etc.)

We will make reasonable efforts to minimize downtime and provide advance notice of scheduled maintenance when possible.

12.3 No Liability for Unavailability

TECHMONKS PLAY is not liable for any loss, damage, or inconvenience caused by temporary unavailability of the platform. We are not responsible for:

  • Loss of access to content during outages
  • Inability to complete assignments or attend live sessions due to technical issues
  • Data loss or corruption during outages
  • Any indirect or consequential damages arising from platform unavailability

12.4 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the platform at any time, with or without notice. We may add, remove, or modify features, content, or functionality as we see fit.

13. LIMITATION OF LIABILITY

13.1 Educational Outcomes

TECHMONKS PLAY provides educational content and learning resources. We do not guarantee specific learning outcomes, skill improvements, or career results. Your success depends on your effort, dedication, practice, and individual circumstances.

13.2 No Career Guarantees

We are not responsible for:

  • Your career decisions or outcomes
  • Job placements or employment opportunities
  • Salary changes or career advancement
  • Acceptance by employers or educational institutions
  • Any personal or professional consequences of using our content

13.3 Content Accuracy

  • While we strive to provide accurate and up-to-date content, we do not guarantee that all information is complete, current, or error-free.
  • Content may become outdated, and we are not obligated to update all materials immediately.
  • You are responsible for verifying important information independently.

13.4 Third-Party Services

  • Our platform may integrate with or link to third-party services (payment gateways, video hosting, etc.).
  • We are not responsible for the availability, functionality, or content of third-party services.
  • Your use of third-party services is subject to their respective terms and conditions.

13.5 Maximum Liability

To the maximum extent permitted by law, TECHMONKS's total liability for any claims arising from your use of the platform shall not exceed the amount you paid to TECHMONKS in the 12 months preceding the claim.

14. TERMINATION OF ACCESS

14.1 Termination by Platform

We reserve the right to suspend or terminate your account and access to TECHMONKS PLAY at any time, with or without cause or notice, if:

  • You violate these Terms & Conditions
  • You engage in fraudulent, abusive, or illegal activity
  • You fail to pay subscription fees
  • Your account poses a security risk
  • We discontinue the platform or your subscription plan

14.2 Consequences of Termination

Upon termination:

  • Your access to the platform will be immediately revoked
  • Your account and associated data may be deleted
  • You will lose access to all premium content and features
  • Any certificates issued may be revoked
  • No refund will be provided for termination due to violation of terms

14.3 Termination by User

You may terminate your account at any time by contacting support@techmonksplay.com or through your account settings. Upon termination, your subscription will not be renewed, but you will retain access until the end of your current billing period (if applicable).

14.4 Survival of Terms

Sections of these Terms & Conditions that by their nature should survive termination (including intellectual property, limitations of liability, and dispute resolution) will continue to apply after termination.

15. CHANGES TO TERMS

15.1 Right to Modify

We reserve the right to modify, update, or change these Terms & Conditions at any time. Changes may be made to reflect:

  • Updates to our services or features
  • Legal or regulatory requirements
  • Platform improvements or policy changes

15.2 Notification of Changes

16.2 Jurisdiction

Any legal proceedings, disputes, or claims shall be subject to the exclusive jurisdiction of the courts of India. You agree to submit to the jurisdiction of Indian courts for resolution of any disputes.

In the event of any dispute, we encourage you to contact us first at support@techmonksplay.com to seek an amicable resolution. If a dispute cannot be resolved amicably, it shall be resolved through appropriate legal channels in India.

18.2 Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

18.3 Waiver

Our failure to enforce any provision of these Terms & Conditions does not constitute a waiver of that provision or our right to enforce it in the future.

18.4 Assignment

You may not assign or transfer your account or rights under these Terms & Conditions without our prior written consent. We may assign or transfer our rights and obligations under these terms to any third party.

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, cyberattacks, or government actions.

  6. You will not download, record, or redistribute any platform content.
